How Will Writing works:

 

  • Before the first visit Wills in English provide a form which helps you to record what you have (Assets - savings, property, chattels etc.) and the offsets against this (Liabilities - mortgage, loans etc) and any guidance you may need. This form is provided as an aid to ensure all elements are covered and to give a measure of magnitude (eg for tax implications) rather than something that needs to be accurate to the last pound.
    Wills in English will provide clear details of charges at this first step, before any are incurred.
  • On the first visit I will explain and advise as appropriate and answer any questions. I will take your instructions and recommend a Will to you after taking account of your particular needs and wishes. When the outline of the Will has been agreed, the date for the subsequent meeting will be arranged.
  • Wills in English will then write your Will(s).
  • On the second visit, Wills in English will talk you through your Will to ensure understanding and agreement and give advice on the final steps for you to validate and safeguard your Will.
  • Wills in English will then be available to provide any advice and, if necessary, updates to your Will should your circumstances change.

Institute of Professional Willwriters

 

Members of the Institute of Professional Willwriters are required to:

 

  • Have passed a written examination to prove their knowledge and expertise.
  • Operate within a strict code of practice.
  • Insist on a 7-day cooling-off period and an independent complaints mechanism.
  • Have professional indemnity insurance for at least £2 million. Nothing should go wrong, but ensure your beneficiaries are protected.
  • Undertake regular refresher training and keep up to date with latest law and practice.
  • Provide a first class, honest and ethical service at a reasonable cost.
  • Provide details of their fees in advance so that there are no nasty surprises.

  • If you become disabled through illness or an accident, have someone you trust ready to act and make important decisions on your behalf.
  • Include guidance and instructions on how they should act. Direct their legal authority so they can handle your affairs effectively and in your interest.
  • Prepare separate Powers of Attorney so the right people can manage your property and business affairs while Health and Welfare matters including medical treatment are considered.
