I provide a thorough, flexible and affordable service which includes Will Writing, Lasting Powers of Attorney and, of course, sound information and advice. The process starts with me visiting you (unless you prefer to come to me) to discuss your requirements and for me to advise and answer your questions. This first part involves a fact find (typically about 45 minutes) and is free of charge (within my area of coverage). If you decide not to continue there is nothing to pay and no obligation. I am available to visit in the evenings, as well as during the day.

 

Wills - my charges start from just £100. Most of my clients prefer home visits, at a time to suit them.

After my first visit I submit my report for review and then follow this with a draft Will. I proceed after each step is agreed. In most cases I make two visits, one at the start and one at the end to supervise you making your Will into a Deed. I can then be one of the two witnesses required by law. Please ask about disbursements.

Lasting Powers of Attorney (LPA)

 

Lasting Powers of Attorney enable your business, property, health and welfare to be managed in accordance with your instructions, while you are living, if you become incapacitated. I (Edward Briscoe) am a professional certificate provider for Lasting Powers of Attorney.

 

An LPA, like a Safety Net, may not seem necessary, but makes a big difference when needed. I make it as easy for you as possible by discussing your options and reviewing your needs and agreeing what will fit well into your applications.

 

I charge £250 per person for both Health & Welfare and Property & Finance.This includes up to 2 home visits. OPG (Office for Public Guardian) registration fees are extra (Currently £82 per LPA).

 

Why should I set up LPAs now?

LPAs can only be used after they have been registered by the Office of the Public Guardian (OPG), so choosing the Attorney(s) and making the necessary applications to the OPG needs to be done at least 6 months before the LPAs are needed, in order for them to be ready.

If an individual's mental capacity has reduced to below a certain level, they will not have the power to appoint an Attorney. While of course hoping this situation doesn't unexpectedly arise, it is best to have an LPA (and hence your instructions) in place in case it does.

If an LPA is not in place and you are too ill to make LPA applications, others will have to apply to the Court of Protection to be appointed Deputies. This is much more expensive and typically takes 6 - 9 months, in which time your affairs are in limbo. The Deputies may or may not be the same people you would have appointed as Attorneys.

 

The situation may be that you just want someone to help you with some specific elements of your day to day affairs. In this case a Property and Finance LPA makes it clear who has your authority to handle things for you and exactly what this authority covers.
